Chicago Home Invasion Defense Attorney

Being charged with home invasion in Chicago is one of the most serious criminal accusations you can face. Under 720 ILCS 5/19-6, home invasion is classified as a Class X felony—carrying mandatory prison time, enhanced sentencing if firearms are involved, and the possibility of a natural life sentence in extreme cases.

If you or someone you care about is under investigation or facing charges for home invasion, it is absolutely critical that you contact an experienced Chicago criminal defense attorney immediately. Attorney Phil Haddad provides strategic, aggressive defense for individuals accused of violent offenses, including home invasion charges throughout Chicago and Cook County.

What Is Home Invasion Under Illinois Law?

According to 720 ILCS 5/19-6, a person commits home invasion if they knowingly and unlawfully enter the dwelling place of another and:

  • Know or have reason to know that someone is present, or
  • Remain inside the dwelling until becoming aware that someone is present, or
  • Falsely represent themselves (such as pretending to be a government or utility worker) to gain entry while someone is inside the home,

And while inside, they do one of the following:

  1. Use or threaten force while armed with a dangerous weapon (not a firearm)
  2. Cause injury to someone inside
  3. Use or threaten force while armed with a firearm
  4. Personally discharge a firearm
  5. Discharge a firearm causing great bodily harm, permanent disability, disfigurement, or death
  6. Commit a sexual offense (including criminal sexual assault or abuse) against someone inside the dwelling

This statute is broader than traditional burglary charges because it requires that the defendant know someone is home and involves violent conduct or threat once inside. The law also applies even if no property was taken.

Penalties for Home Invasion in Chicago (Class X Felony)

Home invasion is always a Class X felony, the most serious category of felony in Illinois short of first-degree murder. It carries mandatory prison time—even for first-time offenders.

Penalties include:

  • Standard Home Invasion (subsections a(1), a(2), a(6))
    – 6 to 30 years in prison, no probation
  • With Firearm Threat/Use (subsection a(3))
    – Additional 15 years added to the sentence
  • Discharging a Firearm (subsection a(4))
    – Additional 20 years added
  • Discharge Causing Death or Great Bodily Harm (subsection a(5))
    – Additional 25 years to natural life added to the prison term

You could be facing decades in prison if convicted. That’s why early intervention by a qualified home invasion defense attorney in Chicago is essential.

Defenses Against Home Invasion Charges

Just because you’ve been charged with home invasion doesn’t mean you’re guilty—or that you don’t have options. At Phil Haddad Law, we investigate every detail of your case and craft a tailored defense strategy.

Common defenses include:

  • Consent to enter the dwelling
  • Lack of knowledge that anyone was present
  • No weapon present or no force used
  • Mistaken identity or false accusation
  • Alibi or misidentification by witnesses
  • Entrapment or unconstitutional police conduct
  • Affirmative defense under 720 ILCS 5/19-6(b) – if you entered unknowingly and left or surrendered without causing harm

We also negotiate with prosecutors to seek charge reductions, especially where no firearm was used or no injuries occurred.
