Penalties and Definitions:

Possession of a stolen firearm is an offense where you have a firearm but are not entitled to have it because you know it is stolen by you or another person or has been converted to mask or change identifying marks like the serial number. If a prosecutor can reasonably show you knew it had been stolen or that has obviously been erased or changed, you will probably be found guilty. If convicted of possessing a stolen firearm, you face the penalties for a Class 2 felony in Illinois. This offense is punishable by three to seven years in prison (seven to fourteen years if an extended sentence) , or else four years’ probation, and fines up to $25,000.
