Definition:

A hate crime is when you perform one of the following crimes listed below against someone because of their race, religion, ancestry, sex or sexual orientation, or because of any disability they have:

  • battery, or 
  • aggravated assault, or
  • intimidation, or
  • stalking, or
  • cyberstalking, or
  • misdemeanor theft, or
  • criminal trespass, or criminal damage to property or vehicle, or
  • mob action, or 
  • disorderly conduct, or 
  • sending obscene messages, or 
  • harassment by telephone or any other electronic means

 

and you do so motivated by one or more of these factors above listed about them that you believe is true about them, whether or not that belief is true.

 

Penalties:

As a Class 4 felony the sentence for a first offense for a hate crime will be between one and three years of incarceration with between three and six years for subsequent offenses or for an extended sentence. Probation for a period of thirty months may instead be possible. Both sentences also carry a $25,000 fine.
